1. About these terms
These terms are a contract between TUN Digital Ltd, trading as CategoryGap (“we”, “us”), and the business that uses CategoryGap (“you”). We are registered in England and Wales under company number 13464714, and our registered office is 2 Frederick Street, Kings Cross, London, WC1X 0ND, United Kingdom. Our VAT number is GB388128953.
By requesting a report, signing in, or buying credits, you accept these terms on behalf of your business, and you confirm that you are authorised to do so. If you do not agree, do not use the service.
Our privacy policy explains how we handle personal data.
2. Business use only
CategoryGap is for businesses. You must use it for purposes relating to your trade, business or profession, and not as a consumer. That is why we only accept work email addresses and refuse personal and disposable email providers. Because you are a business, consumer protection rights such as the 14-day cancellation period for consumers do not apply.
3. Your company account
Your account belongs to your email domain. Anyone who confirms an email address at your domain (for example, name@yourcompany.com) joins your company account. They can see all of its reports, use its credits and buy more. Each subdomain is a separate account.
The first person to join is the account owner. Owners can block and unblock people, make other people owners, and manage the monthly plan.
You are responsible for:
- controlling who has mailboxes at your domain, and blocking people who should no longer have access;
- everything done through your account; and
- telling us promptly at hello@categorygap.com if you think someone has used your account without permission.
4. Reports and credits
- Each company’s first report is free. There is one free report per email domain.
- After that, each report uses one credit. Credits are used in this order: the free report, then monthly plan credits, then pack credits.
- Credits from a one-off pack do not expire while your account is open.
- Monthly plan credits are replaced at the start of each billing period. Unused plan credits do not carry over, and they end when the plan ends.
- If a report fails and cannot produce results, we return its credit automatically. A report that finishes with some data missing, for example because a data source was unavailable, still uses its credit.
- Credits have no cash value, cannot be moved to another account, and cannot be exchanged for money except as these terms say or the law requires.
5. Prices and payment
Prices are shown in pounds sterling on the billing page before you buy. VAT is added where it applies. Stripe processes all payments for us, and you also agree to Stripe’s terms when you pay.
Monthly plans
- A monthly plan renews automatically each month, and we charge your payment method at the start of each period, until the plan is cancelled.
- An account owner can cancel at any time from the billing page. The plan then ends at the end of the current billing period, and its credits end with it. We do not refund part-used periods.
- If a payment fails, we will email you. We may stop adding plan credits until payment succeeds.
- If we change the price of a plan, we will email account owners at least 30 days before the new price applies, so you can cancel first.
Refunds
Payments are not refundable once credits have been added, except where these terms say otherwise, where we have charged you in error, or where the law requires it. If you think a charge is wrong, email hello@categorygap.com.
6. Acceptable use
Only submit pages from websites you own or manage, or have permission to analyse. You must not:
- use the service for anything unlawful, or to infringe anyone else’s rights;
- try to get around credits, rate limits, the free report limit, or security controls, including by using several domains or accounts to get extra free reports;
- try to access reports or accounts that are not yours;
- copy, scrape, reverse engineer or resell the service, or use it to build a competing product;
- overload, disrupt or test the security of the service without our written permission; or
- share access or reports in a way that breaks these terms or the law.
7. How reports work
To build a report we read publicly available pages from your website and from websites that rank in search results, and we use search data from third parties and, if you connect it, from your Google Search Console. We do not try to get around a website’s instructions to automated readers.
Reports are estimates. Search volumes, rankings and page classifications come from third-party data and automated analysis, including AI-generated page suggestions, and they can be incomplete or wrong. A report is not a promise of traffic, rankings or revenue. Check recommendations before you act on them. You are responsible for the pages you publish.
8. Google Search Console
Before a report starts, we may offer to connect Google Search Console so the report can include your own search positions. Connecting it is optional; the report runs without it if you decline.
If you connect a Google account, you confirm that you are allowed to share that website’s Search Console data with everyone in your company account. Reports for that website will use the connected Google account automatically, whoever in your company account starts them, until access is removed.
We only read Search Console data; we cannot change anything in it. You can remove our access at any time in your Google Account at myaccount.google.com/permissions. How we access, use, store and share data from Google is explained in the Google user data section of our privacy policy, and our use of it follows the Google API Services User Data Policy, including the Limited Use requirements.
Your use of Google’s services is also governed by Google’s own terms. Google and Google Search Console are trademarks of Google LLC. CategoryGap is not endorsed by or affiliated with Google.
10. Intellectual property
We own the service, including its software, design, methods and brand. These terms do not transfer any of our intellectual property to you.
You keep all rights in the information you give us. You allow us to use it to provide and improve the service. Data we receive from Google Search Console is only used as described in our privacy policy.
You may use reports produced for your account for your business’s own purposes, including creating and publishing pages based on them, both during and after your use of the service. You may not resell reports or publish them as a product of your own. Third-party data within reports remains subject to its owners’ rights.
If you send us feedback or suggestions, we may use them without any obligation to you.
11. Availability and changes to the service
We aim to keep CategoryGap available and working well, but we do not promise that it will be uninterrupted or error-free. We may need to pause it for maintenance, security or reasons outside our control. We may change, add or remove features. If we stop offering the service altogether, we will give you at least 30 days’ notice and refund any unused pack credits.
12. Suspending or ending your use
You can stop using CategoryGap at any time. To end a monthly plan, cancel it from the billing page. To have your account deleted, email hello@categorygap.com.
We may suspend or end your access, immediately if necessary, if you break these terms, do not pay, use the service in a way that could harm us or other customers, or if the law requires it. If we end your access for any other reason, we will give you at least 30 days’ notice and refund any unused pack credits.
The sections on intellectual property, liability and the law that applies continue after your use ends.
13. Our responsibility to you
We will provide the service with reasonable care and skill. Apart from that and anything else these terms expressly say, the service is provided “as is”, and we exclude all other terms, conditions and warranties to the extent the law allows.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded under the law of England and Wales.
Subject to that, we are not liable, whether in contract, tort (including negligence) or otherwise, for:
- loss of profits, revenue, sales, business, contracts or opportunity;
- loss of goodwill or reputation;
- loss or corruption of data; or
- any indirect or consequential loss.
Subject to the same exceptions, our total liability to you for all claims arising from or connected with the service in any 12-month period is limited to the greater of the amount you paid us in that period and £100.
You are responsible for any loss we suffer because of claims made against us that arise from your breach of the acceptable use section.
14. Changes to these terms
We may update these terms. The date at the top shows when they last changed. If a change materially affects you, we will email account owners at least 30 days before it takes effect. If you keep using the service after that, the new terms apply. If you do not agree, stop using the service and cancel any plan before the change takes effect.
15. General
- These terms, together with the prices shown when you buy, are the whole agreement between you and us about the service.
- We may send notices to the email address of your account owners. You can send notices to hello@categorygap.com.
- We are not responsible for delays or failures caused by events outside our reasonable control.
- We may transfer our rights and obligations under these terms to another organisation, for example if our business is sold. You may not transfer yours without our written agreement.
- If a court decides part of these terms cannot be enforced, the rest still applies.
- If we delay enforcing any right, we can still enforce it later.
- No one other than you and us has any right to enforce these terms under the Contracts (Rights of Third Parties) Act 1999.
16. Which law applies
These terms, and any dispute or claim arising from or connected with them or the service (including non-contractual disputes or claims), are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction.
